About Agreement

The Platform intends to provide e-commerce functionality that enables the purchase and sale of certain electronic goods (“Digital Goods”) to external users, third party of the Platform (seller or buyer, as the case may be; collectively, the “User”).

Account Management

Stripe Affiliate Account Agreement. Certain payment processing services are provided to certain Users through the Platform provided by Stripe and are subject to the Stripe Connected Accounts Agreement, including Stripe’s Terms of Service (calling out the “Stripe Terms of Service”). collectively referred to as the “Stripe Service Agreement”). . By accepting this Agreement, you also agree, to the extent applicable, to be bound by the Stripe Services Agreement (as may be modified by Stripe from time to time). As a condition of Jomedit allowing payment processing services through Stripe, you agree to provide only true, accurate, current, and complete information about yourself (or your principal; see above. ) and update this information as necessary to maintain its truthfulness and accuracy. You also authorize Jomedit to share this and other transactional information in connection with your use of the payment processing services offered by Stripe.

PayPal account agreement. Certain payment processing services are provided to certain Users through the Platform provided by PayPal and are subject to the PayPal Services Privacy Policy. By accepting this Agreement, you also agree, to the extent applicable, to be bound by the PayPal Services Privacy Policy (as may be modified by PayPal from time to time). As a condition of Jomedit allowing payment processing services through PayPal, you agree to provide only true, accurate, current and complete information about yourself (or your principal; see above. ) and update this information as necessary to maintain its truthfulness and accuracy. You also authorize Jomedit to share this and other transactional information in connection with your use of the payment processing services provided by PayPal.

Creator Service

Upon account creation, Jomedit will provide you with access to the Jomedit Vendor Services and/or, where applicable, the Jomedit Creator Services (see below).

Supplier of Jomedit. The Jomedit Creator service allows you to promote, market, or advertise (“Advertisement”) your Digital Goods and to sell, distribute or deliver (“Delivery”) such Digital Goods to third party purchasers (“Buyer”).
Jomedit Creator. The Jomedit Creator service allows you to promote and distribute your digital goods (in a combined quantity in a calendar year higher than permitted under the Jomedit Creator service) and/or financial resources. The physical property of the product has any value to the buyer.
Jomedit Affiliate Program. You may voluntarily participate in the Jomedit Affiliate Program (“Affiliate Program”), which entitles an eligible Affiliate to be bound by the Affiliate Program Terms and Conditions (each, one “Affiliate”) “) to earn financial compensation (each, one “Payment”) for selling your Digital Goods to Buyers from Links posted on the Originated Site (with each resulting sale is a “Transaction”). “Link” means an embedded graphic, icon, text or HTML provided by Jomedit that contains unique hypertext that points to the Universal Resource Locator (URL) address to the Digital Asset of you, allowing Jomedit to identify the Affiliate as the source of the transaction. “Supplied Site” means Jomedit’s website, the Affiliate’s website, or the third-party website on which the links are posted. For each Successful Transaction, the Affiliate will then receive a commission equivalent to:
retail price of the Digital Goods multiplied by the Affiliate Percent (“Payout Rate”) that you determine for that Digital Good at the time the Transaction is completed (the proceeds, ” Affiliate fee”). For example, if a digital good is sold for a retail price of RM 10 through a transaction and the pay-out percentage is set to ten percent (10%), the affiliate fee will be equivalent to RM 10 multiplied by 10% = RM1

Fees, Balance Refunds, Taxes and Conversions

Fees. Jomedit does not evaluate or collect any “listing” or “insert” fees, but will assess and charge per transaction (“Jomedit Fees”). You can view the current fees associated with the Jomedit service. All fees are determined by Jomedit and are subject to change without notice. Details of fees for digital goods as follows:

Digital assets. For your digital assets, you may upload digital files (including but not limited to .mp3, .pdf, .png, .jpeg) onto the Platform and promote Digital Goods at a retail price determined by you, in your sole and absolute discretion (“Retail Price”). Upon receipt of Buyer’s offer to purchase Digital Goods, Jomedit will immediately make technological efforts to digitally duplicate the Digital Goods (resulting in a “Digital Copy”) and purchase such Digital Copy from you for the same price as the retail price below Jomedit’s Fee minus the affiliate fee (see above) (collection, “Wholesale Price”). The wholesale price will be paid to you and will accrue to your balance (“Balance”). When purchasing a Digital Copy from you, Jomedit will have legal custody of the Digital Copy and agree to sell the Digital Copy to the purchaser for retail price plus any value-added tax.

Use of the platform

Use of the Platform
When you operate the Platform, you assent that:
1. You will now no longer, or try to, make any unlicensed or unauthorized use of, or in any other case infringe violate or misappropriate, any patent, copyright, trademark, change secret, proper of privacy, proper of publicity, or different highbrow belongings or proprietary proper (collectively, “IP Rights”) of any entity or individual, consisting of, with out limitation, incorporating any original, variant or misspellings of any third-birthday birthday celebration trademarks, provider marks, innovative assets, or different emblem identifiers with out right authorization;

8. You will now no longer require or recommend that a Buyer conform to any phrases that lessen or restriction Jomedit’s go back and refund policy (see Section 7, below);

9. You will quickly:
(i) respond to requests from Jomedit;
(ii) notify Jomedit of any legal or regulatory claims, or threats of such claims, that you receive in connection with or in connection with any Physical or Technical Product which digital; and
(iii) in connection with (ii) directly above, assist, at its own expense and expense, in taking any appropriate or necessary action as may reasonably be requested by Jomedit to respond to respond to and/or resolve such complaints;

10. You will comply with all applicable laws, regulations, court orders, third party rights, industry requirements (including but not limited to all applicable provisions in the operating regulations) international standards, the MasterCard Merchants rules and the PCI Compliance Standard) and any Jomedit policies or standards that may be enacted from time to time.

11. Where you are advertising or distributing digital goods or physical products that contain another individual’s personal information, you must provide such notice to the data subject as required by law. applicable law and, to the extent required by applicable law, establish a legal basis for your use of such personal data.
